§ 1 Scope
(1) These General Terms and Conditions (GTC) apply to all orders placed by consumers through the online shop sense5.me with ffount GmbH, Heumarkt 7, 96047 Bamberg, Germany (hereinafter “SENSE5” or “we”).
(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (section 13 of the German Civil Code, BGB). Our online shop is aimed exclusively at consumers. Separate terms apply to orders from businesses; please contact hello@sense5.me in that case.
(3) We do not accept any deviating terms of the customer unless we have expressly agreed to their validity in writing.
§ 2 Conclusion of contract
(1) The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order.
(2) You can place our products in the shopping cart and correct your entries at any time during the order process. By clicking the “Buy now” button (or the equivalent button in the checkout) you submit a binding offer to purchase the goods in the shopping cart.
(3) After your order has been received, you will automatically receive an email confirming receipt of your order and listing its details (order confirmation). This order confirmation does not yet constitute acceptance of your offer.
(4) The purchase contract is concluded when we accept your order by means of a separate shipping confirmation by email or when we dispatch the goods to you, at the latest upon delivery of the goods. If we do not accept your offer within five days, this constitutes a rejection; any payment already made will be refunded without delay.
(5) Where payment is made via PayPal or another payment method in which payment is triggered directly during the order process (such as Shop Pay, Apple Pay or Google Pay), the contract is concluded when the payment instruction to the payment service provider is confirmed.
(6) We store the text of the contract. We send you the order details and these GTC by email together with the order confirmation. The currently applicable GTC can be accessed at any time at sense5.me.
(7) The contract may be concluded in German, English, Spanish, French or Italian. The language in which you completed the order process is decisive. In the event of discrepancies between the language versions of these GTC, the German version prevails.
§ 3 Prices and shipping costs
(1) All prices stated are final prices in euros and include statutory VAT. For deliveries to Switzerland, prices are shown without German VAT; instead, the Swiss import charges under paragraph 4 apply.
(2) In addition to the product prices, shipping costs apply, which are shown to you during the order process before you place the order. The following shipping costs apply:
- Germany: €5.90 per order; free of charge from a goods value of €150.
- Other member states of the European Union: €16.90 per order.
- Switzerland: €26.90 per parcel, regardless of weight and order value.
(3) No customs duties or import charges apply to deliveries within the European Union.
(4) For deliveries to Switzerland, Swiss import charges (import VAT and, where applicable, customs duties) as well as a customs clearance fee charged by the delivery company apply in addition. These amounts are included neither in the purchase price nor in the shipping costs. We deliver to Switzerland duty and tax unpaid (delivery term DAP – Delivered at Place): the charges and fees are collected directly from you by the delivery company upon delivery. Their level depends on the value of the goods and the rates applicable in Switzerland.
§ 4 Payment
(1) We offer payment by credit and debit card as well as via Shop Pay, Apple Pay, Google Pay and PayPal. Depending on the delivery country, further local payment methods may be available. What is decisive are the payment methods actually shown to you in the checkout.
(2) The purchase price is due upon conclusion of the contract. For card and wallet payments, your payment method is charged when the order is completed. For payments via PayPal or a local payment method, processing takes place in accordance with the terms of the respective provider, which are shown to you there.
(3) We reserve the right not to offer individual payment methods in individual cases.
§ 5 Delivery
(1) We deliver to the member states of the European Union and to Switzerland, in each case to the countries selectable in the checkout. Deliveries to other countries are not possible through this online shop.
(2) The delivery time is 2 to 5 working days within Germany, 3 to 6 working days to the other member states of the European Union and 5 to 10 working days to Switzerland. For payment methods similar to advance payment, the period begins on the day after the payment order is issued; for all other payment methods, on the day after the contract is concluded. If the last day of the period falls on a Saturday, Sunday or public holiday at the place of delivery, the period ends on the next working day. For deliveries to Switzerland, delivery may be further delayed by customs clearance; delays caused solely by processing by the customs authorities are outside our control.
(3) Shipping is carried out by a logistics provider commissioned by us. Delivery to parcel stations is possible provided the shipping service provider supports it.
(4) If an ordered product is unavailable through no fault of our own, we will inform you without delay and refund any payment already made without delay.
(5) Please check the parcel for externally visible transport damage on receipt and report any damage to hello@sense5.me as soon as possible. Failing to report damage has no effect on your statutory warranty rights, but it helps us to assert claims against the carrier.
§ 6 Retention of title
The goods remain our property until payment has been made in full.
§ 7 Right of withdrawal
(1) As a consumer you have a statutory right of withdrawal. The details are set out in the cancellation policy, which you will find below in these GTC and separately at sense5.me/policies/refund-policy. The model withdrawal form is also available there.
(2) Sets and bundles (such as the S5 Trilogy °01 set in the wooden box) are sold as a single item at a total price. Withdrawal is therefore only possible for the complete set, not for individual components.
(3) You bear the direct costs of returning the goods unless the goods are defective or we have delivered the wrong item. In those cases we bear the return costs and provide you with a return label on request.
(4) You are only liable for any diminished value of the goods resulting from handling that is not necessary to establish the nature, characteristics and functioning of the goods. Opening the bottle closures, removing concentrate, wearing or washing textiles and removing the seal of the wooden box go beyond mere inspection.
§ 8 Warranty
(1) The statutory rights in respect of defects apply. The limitation period for claims based on defects is two years from delivery in the case of new goods.
(2) We do not grant guarantees in the legal sense unless we have expressly designated a guarantee as such.
§ 9 Liability
(1) We are liable without limitation for damage arising from injury to life, body or health, for intent and gross negligence, for fraudulent concealment of a defect, where a guarantee has been assumed and under the German Product Liability Act.
(2) In the event of slightly negligent breach of a material contractual obligation (an obligation whose fulfilment is essential to the proper performance of the contract and on whose observance you may regularly rely), our liability is limited to the foreseeable damage typical for this type of contract.
(3) Otherwise our liability is excluded. This also applies to the personal liability of our legal representatives and vicarious agents.
§ 10 Vouchers and discount codes
(1) Promotional and discount codes can only be redeemed within the stated promotional period and only as part of the order process before the order is completed. Subsequent crediting is not possible.
(2) Only one discount code can be redeemed per order. Discount codes cannot be combined with other promotions unless expressly stated otherwise and are not paid out in cash.
(3) In the event of withdrawal, the value of a discount code is applied pro rata to the returned goods; the amount actually paid is refunded.
§ 11 Information on the use of our products
(1) Our sauna infusion concentrates are intended exclusively for use as a sauna infusion. They are diluted with water and poured onto the sauna heater or the infusion stone. The dosage instructions on the label must be observed.
(2) The concentrates are not suitable for consumption, must not be applied undiluted to the skin and must be kept away from children. In case of contact with the eyes, rinse thoroughly with water. Further safety and hazard information can be found on the label and in the “Legal information” section of the relevant product page.
(3) We accept no liability for damage caused by improper use or failure to observe the instructions for use, unless liability is mandatory under § 9.
§ 12 Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. You can reach us with questions or complaints at hello@sense5.me.
§ 13 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you have your habitual residence in another member state of the European Union or in Switzerland, mandatory consumer protection provisions of that state remain unaffected by this choice of law.
(2) Should individual provisions of these GTC be invalid, the validity of the remaining provisions remains unaffected.
Cancellation policy
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period will expire after fourteen days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. If you ordered several goods in one order which are delivered separately, the period begins on the day on which you or a third party indicated by you acquires physical possession of the last good.

of your decision to withdraw from this contract by an unequivocal statement (a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over, without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us, to
